PURCHASE TERMS & CONDITIONS IN NORWAY

These terms and conditions apply when you, as a customer, place an order from www.mymalagarden.com.
Applies to all customers in Norway.
Purchase conditions:

These terms and conditions apply to all sales from mymalagarden.com. The terms and conditions of purchase, your order and order confirmation, together constitute the agreement between you as a customer and My Mala Garden.

Ordering
All prices include VAT. The total cost of the purchase will be shown before final ordering and will include all expenses associated with the purchase such as shipping, packaging, etc.
Shortly after we receive your order, you will receive an order confirmation by e-mail. If you do not find this in your inbox, it is most likely in your junk/spam folder. If you have not received any form of order confirmation, there has been a technical error, please contact us at sandra@mymalagarden.com
Your order is binding when the order is registered and you have received confirmation. You can still cancel the purchase according to Norwegian law.
Please review the order confirmation carefully, if anything is not correct – please contact us.
Delivery
We ship the goods with Posten/Bring. You will receive the package in your mailbox or pick up the package at your local post office/mail-in-store.
Delivery of the products will be made in the manner described in the order confirmation. If the delivery of the products is delayed beyond the given timeframe, you will be informed of when possible delivery can take place. Normal delivery time is 2-6 business days.
When we have sales, or for other reasons there may be a particularly high demand, the processing of orders and inquiries may take slightly longer. Our experience is that the Post Office gives a delivery time of 2-4 business days. This depends on where in the country you live.
After receiving the products, you should, as soon as possible, check whether the delivery is in accordance with the order confirmation, whether the products have been damaged during transport, or whether the products are otherwise defective or missing. Please contact us if anything does not meet your expectations.
Payment
At My Mala Garden you can pay with most credit and debit cards. If you pay with a debit or credit card, we use Stripe's payment solution. In addition, you can also pay with Vipps & Paypal. After the purchase, a receipt for your transaction will be sent directly to your email address. Our online store ships goods from Oslo.
Delivery
My Mala Garden ensures fast delivery throughout Norway with 2-6 days delivery time subject to sold out items. There may be extended delivery time in December. We send our packages with Posten/Bring with tracking number.
My Mala Garden cannot take responsibility for delays with the package distributors.
Right of withdrawal, returns and complaints
Right of withdrawal and return
There is a 14-day cancellation and return policy on all items, calculated from the day you receive the item. If you cancel a purchase, you must return the item in the same condition as you received it. You are welcome to try the item on, but My Mala Garden considers that the item has been used, and the item cannot be returned. The item is considered to have been used if it is used beyond what is normal when trying on an item in a physical store.
Please contact sandra@mymalagarden.com with information about the return. Once the item has been received and approved, the money will be credited to your account within a few days. You are responsible for the shipping costs for the return.
Complaints
My Mala Garden offers a 12-month warranty in accordance with the Norwegian Sales Act for extensive manufacturing and material defects, which are discovered during the normal use of the product.
The right of complaint does not cover defects, damage or wear and tear, directly or indirectly arising as a result of incorrect treatment, poor maintenance, violence or unauthorized interventions.
Complaints about defects and deficiencies, which should be discovered during normal inspection of the item, must be reported in writing with a photo to sandra@mymalagarden.com within 14 days of purchase. My Mala Garden does not want to receive returned items with defects/damage. Instead, contact us and we will resolve the situation via email.

Complaints and exercising the right of withdrawal follow established Norwegian law. See the Consumer Purchase Act and the Right of Withdrawal Act.
Personal information
When you shop with us, we store delivery and contact information. This is data we need to deliver the goods to you via the carrier you choose, as well as contact you about matters related to your order. This information is used exclusively for processing the order.
My Mala Garden is also required to retain this information in connection with accounting, tax management and any warranty/return handling.
No personal information registered on mymalagarden.no will be transferred, sold or made available to a third party. All information is kept secure and is only accessible to My Mala Garden.
Credit information is not retained by My Mala Garden beyond what is necessary to ensure efficient handling of any issues with charging, cancellation of reservations and crediting.
In accordance with the Norwegian Data Protection Act, you can request information about what specific information My Mala Garden has registered about you. Based on any objections, deletion can be carried out to the extent desired.
Conflict resolution

Forbrukertilsynet.no: Complaints must be addressed to the seller within a reasonable time, cf. points 9 and 10. The parties shall attempt to resolve any disputes amicably. If this is unsuccessful, the buyer may contact Forbrukertilsynet for mediation. The Consumer Authority is available by telephone at 23 400 600.
